Terms of Service

1. Agreement

These Terms govern your use of Bertram, a Telegram-based assistant operated by Giant Lambda Ltd (“Giant Lambda”, “we”, “us”), registered in England & Wales at 90 Camden Road, Tunbridge Wells, Kent, TN1 2QP. By using Bertram, you agree to these Terms. If you don't agree, please don't use the service.

2. Closed beta

Bertram is currently in closed beta. The service is provided as-is and may change, break, or be discontinued without notice. Features may be added or removed. We may limit or suspend access for any reason during the beta period.

3. Eligibility

You must be at least 16 years old and able to form a binding contract under the laws of your jurisdiction. You must also comply with Telegram's own Terms of Service — if Telegram suspends your account, you won't be able to use Bertram.

4. Acceptable use

You agree not to use Bertram to:

• Break any law, or help someone else break any law
• Harass, defraud, impersonate, or harm anyone
• Generate or distribute illegal content, including CSAM
• Reverse-engineer, scrape, or overload the service
• Resell or white-label the service without written permission
• Bypass rate limits, authentication, or other security measures

We may suspend or terminate your access for violations, with or without notice.

5. AI output disclaimer

Bertram uses large language models. Its output can be wrong, incomplete, or misleading. Don't rely on Bertram for legal, medical, financial, or other professional advice. You are responsible for reviewing anything Bertram produces before you act on it.

6. Actions on your behalf

Bertram will confirm with you before taking actions that have real-world consequences (sending messages, booking, purchasing, etc.). Once you confirm, the action is your responsibility. If Bertram makes a mistake, let us know and we'll investigate — but we can't guarantee recovery, reversal, or reimbursement.

7. Your content

You keep ownership of anything you send to Bertram. You grant us a limited licence to process your content solely to operate the service (including sending it to our sub-processors as described in our Privacy Policy). We don't use your content to train AI models.

8. Our intellectual property

Bertram, the name, the mascot, and the underlying software are owned by Giant Lambda. These Terms don't grant you any rights to our trademarks, brand, or code beyond using the service as intended.

9. Fees

Bertram is a paid service. Current pricing and plans are shown at sign-up and inside the product. Fees are billed in advance and are non-refundable except where required by law. We may change pricing with reasonable notice; changes won't affect a billing period you've already paid for. Because Bertram is in closed beta, plans and limits may change — if a change materially reduces what you're paying for, you can cancel for a pro-rata refund of the unused portion.

10. Cancellation right (consumers)

If you're a consumer in the UK or EU, you normally have 14 days to cancel a contract for digital services for any reason. Because Bertram starts working the moment you subscribe, we ask you at checkout to expressly agree that the service begins immediately and to acknowledge that, by doing so, you lose the right to cancel once the service has been fully supplied. For any portion not yet supplied, you can still cancel within the 14-day window by emailing contact@giantlambda.com, and we'll refund the unused portion. This does not affect your statutory rights.

11. Termination

You can stop using Bertram at any time by blocking the bot on Telegram or emailing us to delete your account. We may suspend or terminate your access if you breach these Terms, if we're required to by law, or if we discontinue the service. Provisions that by their nature should survive termination (liability, IP, governing law) will survive.

12. Disclaimers

To the fullest extent permitted by law, Bertram is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We don't guarantee the service will be uninterrupted, timely, secure, or error-free.

13. Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited under English law. Subject to that, Giant Lambda's total aggregate liability to you in any twelve-month period is limited to the greater of (a) the fees you paid us in that period, or (b) £100. We are not liable for indirect, incidental, consequential, or loss-of-profit damages.

14. Indemnity

You agree to indemnify and hold Giant Lambda harmless from claims arising out of your misuse of the service or violation of these Terms, to the extent permitted by law.

15. Changes

We may update these Terms from time to time. Material changes will be notified through Bertram or by email. Continued use after changes means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers may have additional rights under local law.
